accused serial killer. what investigators found in two safe-deposit boxes. a live look outside, looks clear by hp pavilion this morning. it's wednesday july 27th. this is "today in the bay." you made it to wednesday morning, 5:00, good morning. thanks so much for joining us. i'm laura garcia-cannon. let's check in with meteorologist christina loren. >> good morning to you. we have a really nice day ahead whether you're waking up inland or at the coast. it's going to be warmer. you'll likely notice the difference but the heat sets in as we head through this weekend. i've got your extended forecast coming up. first 5:00 a.m., let's see what the roads look like with mike. >> good morning, christina. towards treasure island, typical overnight maintenance zone until 6:30 on the lower deck. getting through oakland highways moving nicely.

we do have a closure 29th, because of police activity. this is a traffic issue, but it's a news story, laura, so i'll hand it to you for what's going on over there. >> thank you very much. we are following a developing story over in east bay where high-speed chase ended deadly, the chase ended off 29th avenue off 880 in oakland. that's where "today in the bay's" christie smith joins us live on the latest in the chase. >> reporter: good morning. this wasn't a very long chase, only a matter of minutes. as you said, deadly consequences. i want to show you the car the driver was in. he crashed right here. chp telling us he was thrown from the car, taken to highland hospital this morning where he died, a 19-year-old male from oakland. this happened around 1:00 in the morning. a very violent night in oakland with a shooting on international boulevard near 47th avenue. oakland police investigating that. we're trying to get details.

then an hour later, similar area, reports of an erratic driver. chp tells us they tried to pull him over but he headed south, started speeding, blowing through stoplights. he gets on 880 and heads north and takes the 29th avenue exit. there's a hairpin turn here. that driver crashed. officers say there was alcohol involved. they found alcohol in and around the car. the whole scene unfolded really quickly. >> it started down on international around 55th avenue and got up onto the freeway at 73rd, lasted approximately, i would say, eight minutes probably. >> now, the coroner is still on scene this morning also. many, many chp investigators. 29th avenue exit. this is heading northbound, we're told, will be closed for quite some time. something to keep in mind if

you're heading this way. reporting live in oakland, christie smith today, in the bay. >> thanks for the details, christie. 5:02, opening statements in the trial of a los gatos mother accused of having sex with a 16-year-old boy. sarah cole is charged with three felony counts of unlawful sex. court documents say cole bribed the boy with marijuana, alcohol, and cigarettes. the boy's parents got police involved after seeing some disturbing text messages on his phone allegedly sent by cole. cole made headlines back in 2007 when she was hit by a drunk driver in los gatos. new revelations about the contents of a safe-deposit box owned by accused serial killer. prosecutors revealed the 77-year-old owns two safe-deposit boxes. in one news clippings about four women he's charged with killing. in the other, cash. a judge has appointed someone to look into his finances to determine if he has enough money to pay for an advisory council.

if he does not not, the public will foot the bill. that decision is expected on friday when he returns to court. he's accused of killing four northern california women in the 1970s and 1990s. people in the san jose neighborhood are on edge this morning after a 13-year-old boy was stabbed walking his dog. police say the boy was attacked with his dog ateson park near the interchange. marla tellez joins us live this morning with an update. good morning, marla. >> reporter: good morning, laura. at first sight i can certainly say with assurance, this does not look to be the sort of neighborhood where crimes like this happen. the park in south san jose surrounded by very nice neighborhoods. in fact, activity like we're hoping you see behind me seems to be more prevalent in this family friendly neighborhood.

this home in tocc1: the distance that got toilet papered overnight. we're familiar with the popular childhood pastime. again, more of a family friendly feel out here this morning. it's hard to get really a sense of it because it's still dark out but we do have daytime video we can bring to you so you can get a look at what i'm talking about. it was monday evening when san jose police say a 13-year-old boy was just walking his dog in this park when two teen boys approached him, asked him if he was in a gang. when he said new york city the teens began punching him and eventually stabbed him in the back several times. a neighbor who did not want to be identified witnessed the whole thing. he says recently crime has become a problem in this typically quiet area. >> it took to get to this point of somebody actually basebaeing established, i'm hoping police will understand what's going on in this park and start watching it more often.

>> almost eight months into this year there, have been almost 30 homicides in san jose. almost half of those have been gang related. tough stats considering the deep budget cuts the city is facing and the recent police layoffs. police say three suspects in this stabbing are in custody, including a 19-year-old. the two others are juveniles. as for the 13-year-old he's recovering in the hospital at valley medical center this morning. his family tells us his kidneys were punctured in the stabbing. but the good news he is expected to recover and actually be released, laura, in the next couple days. >> that's good news, exactly, just walking a dog. thank you very much, marla. the gunman that fired on an ebay police officer taken off. helicopters swept the east bay hill yesterday and didn't find the gunman. they think the men were protecting a marijuana grow operation. they say they will return with

reinforcements to get rid of those plants. concern this morning about a mountain lion that's killing animals near half moon bay. state game officials say dead sheep and dpoets found near highway 1 monday night. after examining the body, the agency determined they were likely killed by a mountain lion. officials say if you encounter a mountain lion, make noise and try to look bigger by waving your arms and throwing rocks. san francisco mayor ed lee is getting more pressure to run for a full term. this time from a former mayor of san francisco. senator dianne feinstein told the chronicle last night, his responsibility is to the people of san francisco and the voters alone should determine whether this talented public servant should continue on the job. feinstein told him in person monday when they both were at the white house for the giants visit. in recent weeks he has been more receptive to returning but is not committed to it.

he's still on vacation until monday. the filing deadline to run for mayor is august 12th. big backing] there from senator dianne feinstein. all right. want to check in with meteorologist christina loren, a little foggy on my drive to work this morning. >> we have a great shot of the moon, kind of one of those mornings where you're clear inland, fog settling on the coast. that shot coming up. pretty spectacular this morning. a mild day ahead. low pressure sitting to the north but pushed north overnight. that's good news. that means we're going to see less in terms of fog. it's out there a little earlier this morning as well, so we're going to lose it quite a bit earlier than we did yesterday, something we will see as we head through the next couple of days as the amplifying ridge of low pressure driving that monsoonal pressure as far north as monterey. for us an impact as we head through friday, saturday, even into sunday. a chance for isolated thunderstorms as this big ridge of high pressure starts to drive our winds offshore.

however, that means we're going to start each and every morning out with less and less cloud cover. 60 in concord, 59 in hayward, 66 in sunnyvale. in the city because i do believe we'll see less cloud cover to start. by noon a mix of sun arnold clouds, 68 degrees. we'll be socked in all day as we have for the most part each and every day. breezy conditions, a comfortable day in the city of san francisco. here is where we're headed elsewhere. 77 in oakland, 89 in concord. i've got that weekend forecast ready to go. we're so close now. want to get you over that hump on a wednesday. see how you're doing in the traffic department. we do have a nice flow right now for the tri-valley area. yesterday, though, late morning commute, we had an accident then a fuel spill. that was what caused all the back-up through livermore this morning. so far holding fine with a 14-minute drive towards the dublin interchange. antioch holds up nicely. last couple of days, monday and tuesday, haven't had major

slowing excels right where 68 is registered. hopefully the rest of the week, summertime traffic has unusual flow patterns here. walnut creek interchange approaching the maze, no problems there. typical overnight maintenance on the lower deck, police activity closing 29th avenue off-ramp at 880 northbound for the next couple of hours. christie smith to follow that scene. meanwhile construction 101 at moffett has cleared. 17 still some down toward the summit. we'll give a shoutout, a jason aldean concert. she's officially not coming in tomorrow. otherwise i'm going to call her and say, hey, i hope you're here tomorrow. >> i wonder which one it is. he's known as the bad boy of country music. kaitlyn, it's got to be. bay area native taking a

welcome back, everyone. that's the fog we're talking about this morning hovering over the coastline, clearing skies, warmer temperatures. we'll check in a bit. 5:14 right now. stanford university hoping third time is the charm as they try to build miles of hiking trails. the $10 million plan would build a two-mile segment in the alpine road trail between menlo park and portola valley. it would replace walkways that are narrow and in some areas a shoulder on the road. the project has been shot down twice in the past due to community opposition. the santa clara board of

supervisors voted yesterday to hear the opinion for the next three months before making a final decision. critics say the plan is like building a sidewalk along a busy road and a hiking and bicycle path. we continue to keep an eye on washington this morning where the fight over the debt ceiling does not seem to be getting anywhere. a vote on house speaker john boehner's debt plan is expected tomorrow but it is not expected to pass in the senate. if a deal is not done and signed by tuesday, the government will default on its loans leading to higher interest rates. that, of course, will cause ripple effect throughout the economy. for a look at how the markets are reacting to debt slowdown let's check in with "today in the bay's" nicole lapin live at cnbc headquarters this morning. good morning. >> a good morning to you. futures are flat after stocks fell again yesterday as investors are starting to get a little worried about the lack of progress on capitol hill to solve the nation's debt crisis. house republicans are now delaying that vote that you were mentioning on john boehner's bill because the congressional

budget office say it may not save as much money as expected. the markets lost ground because of disappointing earnings as well, not just what's going on in washington. specifically from the likes of m and ups. asian markets were down over europe also lower, data on durable goods we are watching and digging through a punch of earnings from the likes of conocophillips. to recap market dow falling 91 points to 12,501, nasdaq composite slipping to 2839. a lot think congress will reach a deal to increase the debt ceiling. there's an increasing chance the ratings agencies could cut the u.s.'s credit rating anyway. how would that, in fact, impact you and me. interest rates is going to be the big answer on mortgages and loans. those could go up. there could be volatility in the stock market. financial advisers are telling clients as long as they are diversified, the best action is to sit tight -- i know it's

tough -- and ride it out. wall street runs on dunkin, the parent company of dunkin' donuts and baskin-robbins, priced its ipo above the expected range, supposed to be $16 to $18, went for $19. dunkin will start trading on nasdaq under the ticker symbol dnkn. i had to tell you, i had the ceo on this morning he gave me all sorts of bear claws and coffee. >> i see a trace of glazed doughnut on you. fantastic. that is talent. >> thanks. thank you, my dear. >> always looking great. thanks so much. 5:17 right now. check out this incredible video of a waterspout in northwestern pennsylvania. home video shows waterspout off of bear beach. it actually formed as strong storms moved through the area yesterday. witnesses say they saw several waterspouts in the area but they all dissipated before reaching land.

luckily no reports of injuries. although waterspouts like this one have been known to cause some serious damage. nice from a distance there. 5:17 right now. time to check in with meteorologist christina loren. >> good morning to you, laura. good morning to you at home. well, you're waking up in san jose, livermore, even concord this morning, you're doing to find a clear shot of that moochmoon. it's absolutely gorgeous out there. we have some significant fog that developed early. there it is. way to go guys in the back. you're on it this morning. this is actually 11% full. you can see where the sun is illuminating that crescent moon. we're three weeks away from the next full moon august 13th. i want to show you how clear it is from the south bay this morning, where we have deep fog starting to develop at the coast. otherwise at the surface you're doing okay for now. we'll let you know when you start to lose visibility on the highway. here we are for today, mild conditions, low pressure sits just to the north.

on-shore flow for the first part of the day but not as strong as it has been. as a result we'll warm up nicely this afternoon. so you've been waiting to wear your summertime weather gear, can you do it today, flip flops, short sleeved shirt, even in the city it will be nice. things change over the weekend as we see monsoonal moisture from the south. this morning we see the flow to the north, monterey and fresno. for us you start feeling muggy conditions as we head through friday and saturday. hey, we're getting closer and closer to the weekend. 59 in hayward. on your way to 86 degrees in places like fremont at 4:00 p.m. and temperatures keep climbing all the way through your seven-day outlook until saturday, then we start to level off. next week looking much, much warmer. back to you, laura. bird lovers, polish up that resume. we found a job that might make you feel pretty ducky. peabody hotel in memphis looking for a new assistant duck master to care for its five famous

good wednesday morning to you. it's 5:22 right now. muni officials will hold a community meeting tonight to discuss big changes coming to a heavily used line in san francisco's neighborhood. parts of the line will be closed next year so construction crews can replace tracks on carl street. tonight's community meeting will give a lot more details on the project which also includes replacement of overhead wires and street repaving. replacement bus service will run while the line is down. tonight's meeting takes place at the park branch library at 6:00 p.m. it's 5:23 right now. let's check the morning commute with mike. >> all right, laura. let's get a look over here at the north bay where we have an accident. northbound 101 on highway 37. right there at the interchange, no injuries reported.

this will be a problem. the southbound side has the slowing. that's because of the construction zone. construction zone at 37 in the southbound direction and continuing with spots all the way through central san rafael. further north in napa, an accident off steel canyon road as well. not a lot going through the area but i want to let locals know about that. that might affect your drive as you're passing through the 1600 block there. construction picked up with exclamation point out of the city for the lower deck. that's much better. still have the closure at the bottom of the screen. northbound 880 at 29th because of police activity. christie smith has been giving us updates live from the scene. expect another hour and a half to two hours for the closure. 6:30, 7:00, we should see activity as you get off there. just use 23rd for the morning to be safe. hayward smooth drive 880 off 238 where jason drove through the area, one of our colleagues at the station, he said there was activity with road crews but

bombing and shooting in that country that killed 6 people. anders breivik has admitted to the attacks but pleaded not guilty. is the government tracking you through your cell phone? scott mcgrew says maybe. >> it sounds, laura, like something you'd find out of the tin foil hat crowd. the head of the nsa has talked to congress and said that might actually happen. they could do it, and there may be legal situations where they would do it. now, congress has demanded more answers in this bizarre thing. they want those answers no later than september 1st. you're looking at a new statement released this morning from hacker groups anonymous. it says members accused of hacking paypal's website aren't hackers at all, they are digital protesters, what some people called hactivism.

laura, so i'm going to hand it to you for details. a high-speed police chase with deadly consequences. a live look at the 29th exit off northbound 880 in oakland where a teenager driver was thrown from his car after leading police on a ten-minute car chase. officers say they spotted the 19-year-old driving erratically around 1:00 this morning. they tried to pull them over but they say he started speeding. he got onto the freeway where he eventually crashed. our christie smith is live at the scene talking to investigators right now. she's going to bring us the very latest in a live report coming up at 6:00. well, three teenagers are behind bars today accused of stabbing a 13-year-old boy while he was walking his dog. jose near the expressway. take a look for yourself, a well kept, well manicured park, nice swing set, playground. off in the distance, nice homes, a cul-de-sac, certainly a safe area, seems to be. it was here monday evening after 5:30 when san jose police say a 13-year-old boy walking his dog when teen boys approached him. they asked him if he was in a gang. he said no. the teen began punching him and stabbed him in the back several times. at least a couple neighbors heard the commotion. one man who didn't want to be identified actually chased down the suspects and talked to us about what he saw. >> i yelled at them, hey, knock it off. that's when i saw the knife come out. and i saw the stabbing. >> he was down on the ground.

he said oh, my gosh, i've been stabbed. am i going to die? >> reporter: so answer that question, no, the boy is going to be fine. he's recovering at valley medical center. the family tells us his kidneys were punctured but he'll be released in a couple days. good news there. three people are in custody for the stabbing including 19-year-old and the two others are juveniles. the man who chased down those suspects, he tells us this area is safe. the fact that this crime happened here has neighbors on edge. he's hoping that this will draw attention to the area and get more police patrol the neighborhood. laura. >> thank you very much, marla. today marks a two month disappearance of nursing student michelle. family and friends will hold a rally in the area where she was sign. she disappeared from the kaiser

permanente in may. they have classified it as a homicide. the family is not giving up. they raised $100,000 for her safe return. the rally held at mount eden park at 6:00. family members, hayward police will be speaking. this morning san francisco 49ers appear closer to sharing a new stadium with their dreaded rivals across the bay. at an nfl function 49ers president jed york told reporters he's been meeting with the raiders on a possible deal. dami damien trujillo. >> sharing it would make a better sales pitch in obtaining financing for the facility and observers say it makes financial sense especially with this rebounding economy. i did receive several tweets overnight. the plan is in place to have the

stadium up and running by 2015. that's when they expect kickoff here. the project is now expected to cost about $1 billion, with a b. the nfl has indicated it prefers a shared stadium idea and the nfl is where a lot of the money to fund the project will be coming from. both the raiders and 49ers currently play in two of the league's oldest stadiums. so both teams have apparently been meeting over the last few months to discuss that possibility. instead of only eight games per season being played at a new santa clara stadium, it would be 16 games. the talks days after a new stadium proposed for that city. that is still in the preliminary planning stages and santa clara already has all of the environmental impact reports virtually completed. now, there are till about $100 million that would come from the redevelopment agency here in the city of santa clara. the question is will that money still be there, because the

governor plans to raid all of those funds and close the redevelopment agencies across the state. wait and see. we're live in santa clara, i'm damian trujillo, "today in the bay." i thought jed york said he would possibly be able to secure a loan from the nfl and part of the money would have to be raised. >> he said that a day or two days ago. apparently while he said that, he was also meeting with the raiders. a dual team stadium makes a lot of sense, if you will, because it would revitalize this area here. let's wait and see. maybe he's playing cat and mouse like jed york is. >> never done that before. thank you very much, damien. 5:37. let's check the forecast and see how things are clearing up in that area with christina loren. >> it's going to get worse instead of better in the fog department especially at the coast. see that marine push all the way inland as it has over the past couple days. things are improving. if you're looking for warmer weather we've got that on the

way for you. right now perfect visibility at the surface. we'll let you know when that changes. mike inouye and myself watching very closely for you this morning. we do have changes, low pressure pushed a little further off to the north this morning and that means we're not going to see as strong of an on-shore flow. still a mild day at the coast. temperatures in the mid to upper 70s, comfortable conditions in oakland where you're at 54 now, same for san francisco. on your way to about 68 degrees by noon with a mix of sun and clouds. so the good news is you're going to see sun break through quite a bit earlier today than previous days. that trend will continue as we head toward the weekend. less and less cloud cover to start you out as high pressure takes control of the weather pattern. by 4:00 p.m. 73 degrees. nice and breezy, should be comfortable in the city. good day for outdoor lunch plans. 86 in fremont later on today, 85 san rafael. santa cruz going to break out of the low 70s, 75 today. let's get you to work on time.

5:38, check the roads with mike. >> all right, christina, toll plaza approaching moving smoothly in all directions, 19 minutes down the freeway. that may change in the next couple of minutes. as we go back to the area right around the racetrack, see it on the left, we do have an accident reported. some debris fell off a truck. sounds like the car behind it hit that debris, eastbound 580 at central avenue. we may see slowing because of the flashing lights as you come off the richmond bridge and mergeing with traffic on the east shore freeway in that direction. follow this, meanwhile track towards antioch where unlike the previous couple days this week, monday and tuesday we're fine here. we're now seeing speeds down towards the 30s, a little below 30 for that 28, earlier and heavier than we've seen traffic flow the last couple of days this week. as i warned you, summertime traffic less predictable than other times of the year. over here 580 shows a nice flow,

new this morning, a look at the crescent moon out there this morning. beautiful start to the day. waiting for the suns big arrival. moving towards the middle, a few days to the august 2nd deadline, democrats and republicans making sacrifices, they say, to come to a debt deal. another bump in the road. tracie potts live in washington joins us with the details. good morning. >> reporter: good morning, laura. there are two plans here on capitol hill that are getting a lot of attention. neither of them is ready for a vote. in fact, both of them have been postponed. first of all on the house side, the boehner plan, republican plan, turns out it doesn't save the trillion dollars he suggested. the congressional budget office looked it over and found it $150 billion short.

now he's going back to the drawing board trying to find those savings and trying to get support from his own party. he can only afford to lose 22 republican votes and get this through and 10 republicans, many of them conservatives, have already said they are not voting for it. the other plan on the senate side, democrats plan, reid plan, isn't something either side is thrilled about. republicans want to see more cuts. democrats think there are already too many. but it may, in fact, be a compromise plan they can move forward with. that one also not yet ready for a vote. the real concern here, has all of this back and fortune certainty and indecision already affected our credit rating? we'll hear from the ratings agencies today. >> they want answers. thank you very much, tracie. 5:44. the tough economy put a bay area animal shelter in a tough spot. they are asking for the community's help. they are trying to raise

$125,000 in the next month to avoid cutting programs and ultimately closing the shelter. directors say they have seen a decrease in donations as operating expenses go up. valley humane society has rescued thousands of animals and provided several pet therapy programs for students and the elderly. firefighters are fighting done cleaning up this morning after a fireball, fueled by plastic, lit up the sky over fairfield. the fire tore through the macros plastics factory near travis air force base. firefighters say using an open flame in the storage area may have sparked the fire. it burned for hours. thick black smoke spewed from the factory and over neighborhoods. no one was injured in the fire. air quality experts and environmentalists are in the area to determine if it's toxic because of burning plastic. there was a voluntary evacuation order in place yesterday. it has since been lifted.

an east bay car thief made off with more than just a set of hot wheels. he now has pricey giants memorabilia as well. walnut creek police say this man right here might be the car thief. he's caught on camera outside mcdonald's on north california boulevard in walnut creek. the car's owner says he was inside getting a cup of coffee when the man hopped into his car and took off. hidden in the back of the car, autographed bats and balls signed by giants legend. the car is a 2011 hyundai sonata. the license plate number on your screen there. if you see it call police. an under water plant is threatening the start of the americas cup. exotic seaweed which can grow 10 feet pose dangers to native habitats throughout san francisco baseman the plant is found at some piers and could attach itself onto spectator boats. state regulators are refusing to

issue permits for the race until organizers can prove the event will not significantly spread that seaweed. one option to deal with the plant is an eradication program which would be funded by the americas cup and port authorities. at annual whale migration under way in south africa. we have video. the migration is a chance to see huge hump backs that come to colombia to mate. they began moving north from antarctic months ago. hundreds of mails passing through the warm water. this breeding site is the end of a 5,000 journey for the whales. after a four month rest, when the newborns are old enough, they will make that return journey back. pretty amazing. 5:47, time to check the forecast with meteorologist christina loren. >> we've had such a mild month, foggy starts are part of the reason why. you can't even make out this live picture of san francisco because the fog is so deep this morning.
